1. Introduction
These Terms and Conditions (“Terms") govern access to and use of the Amrita Books Application, associated website(s), products, Digital Content and related services (“Services").
Amrita Books is a unit of Amrita Enterprises Private Limited (“AEPL"), and the Amrita Books Application is owned and operated by AEPL.
By creating an account, using the Application, purchasing a physical book or subscribing to Digital Content, the user acknowledges that the User has read, understood and agrees to these Terms and the applicable Privacy Policy.
2. Services Offered
The Application provides or may provide:
a. Physical Books (Hard Copies)
Printed books and publications available for purchase and delivery.
b. Digital Books/eBooks
Complete eBooks made available through individual paid subscriptions.
c. Audiobooks – Future Service
Audiobooks and related digital-audio services may be introduced in the future as a separate paid subscription service.
An eBook subscription or purchase of a physical book does not automatically provide access to audiobooks. Users will be required to pay the applicable separate audiobook subscription fee.
For these Terms, “Digital Content" includes eBooks, audiobooks when introduced, and other digital publications/media made available through the Application.
The availability of particular Digital Content may depend upon applicable intellectual property rights, licences, technical requirements and contractual arrangements with authors, publishers, licensors or other rights holders.
3. User Accounts
Users must provide accurate and current information and are responsible for maintaining the confidentiality and security of their account credentials.
Users must not share their account or permit unauthorized persons to access Digital Content through their account.
Amrita Books should be notified promptly of suspected unauthorized access.
Amrita Books may require verification of the User’s email address, mobile number, identity or other information where reasonably necessary for account security, fraud prevention or compliance with applicable law.
4. Eligibility
Users must have the legal capacity required under applicable law to use the Services and enter into purchases or subscriptions.
Users who are minors may use the Services only with the involvement, supervision and consent of their parent or lawful guardian where required under applicable law. Where a transaction is entered into by or on behalf of a minor, the parent or lawful guardian shall be responsible for ensuring compliance with these Terms and applicable law.
5. Physical Books
Physical books may be purchased through the Application.
Product descriptions, prices, availability, applicable taxes and other relevant information will be displayed through the purchasing interface.
Amrita Books may correct genuine pricing, description or availability errors, subject to applicable law.
6. Shipping and Delivery
Physical books will be shipped to the address provided by the customer through available postal, courier or logistics services.
Delivery periods are estimates unless expressly stated otherwise and may be affected by destination, carrier operations, customs, weather, public holidays or other circumstances outside the reasonable control of Amrita Books.
For international orders, applicable customs duties, import taxes or other destination-country charges may apply.
7. Cancellation, Returns, Replacement and Refunds – Physical Books
The cancellation, return, replacement and refund terms applicable to Physical Books are set out in the Amrita Books Return, Cancellation, Replacement and Refund Policy, as amended from time to time in accordance with applicable law. The applicable policy shall be made available to the User before completion of the relevant transaction.
Where an ordered physical book is unavailable and the order cannot be fulfilled, the amount paid for that unavailable book will be refunded-subject to the applicable payment-processing/banking timelines.
8. Individual eBook Subscriptions
eBooks are provided through individual paid subscriptions.
A user may subscribe to an individual eBook by paying the applicable subscription fee displayed through the Application.
Upon successful activation, the subscriber receives access to the complete subscribed eBook for the applicable subscription period.
The price, duration, renewal conditions and other material subscription terms will be displayed before subscription.
Unless expressly stated otherwise, an eBook transaction constitutes a subscription/licence for access to the relevant Digital Content for the specified subscription period and does not constitute a sale or transfer of ownership of the Digital Content.
9. Download and Offline Reading
Subscribed eBooks may be downloaded through the Application for offline reading.
Downloaded eBooks remain protected Digital Content and may be used only through the authorized functionality of the Amrita Books Application.
Users must not copy, extract, reproduce, transfer, distribute, share, publish or resell downloaded eBooks.
Upon expiry of the applicable eBook subscription, access to the eBook, including the downloaded/offline copy, will be locked. The subscriber must renew/re-subscribe to regain access to the eBook.
10. One-Device-at-a-Time Access
An individual eBook subscription may be accessed on one device at a time.
Simultaneous access to the same subscription on multiple devices is not permitted.
A subscriber may be permitted to transfer or activate access on another compatible device according to Amrita Books’ technical and security procedures.
Amrita Books may use reasonable authentication, device-management and security measures to enforce these restrictions.
11. Digital Content Licence
Subscription to, downloading of or access to Digital Content does not transfer ownership, copyright or other intellectual-property rights to the subscriber.
Subject to payment and compliance with these Terms, the subscriber receives a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to access and use subscribed Digital Content solely for personal, non-commercial purposes during the authorized subscription period.
Users must not copy, reproduce, share, distribute, resell, rent, sublicense, upload or commercially exploit Digital Content; extract or systematically reproduce protected material; create unauthorized derivative copies; circumvent DRM, encryption, authentication or device restrictions; or facilitate unauthorized access.
12. Audiobook Subscription – Future Service
Amrita Books may introduce audiobooks and related digital-audio services in a future phase.
Audiobooks will be offered as a separate paid subscription service. Payment for an eBook subscription, physical book or other Amrita Books product does not automatically provide audiobook access.
Before subscription, the applicable audiobook subscription price, duration, renewal/cancellation conditions, content-access conditions and other material terms will be displayed to the user.
Audiobooks will be subject to the Digital Content Licence and intellectual-property protections contained in these Terms and any additional terms applicable to the audiobook service.
13. Intellectual Property Rights
Unless otherwise expressly stated, intellectual-property rights in the Application and Digital Content, including copyrights, trademarks, text, photographs, illustrations, graphics, logos, designs, software and other materials, belong to AEPL/Amrita Books, their licensors or the respective lawful rights holders.
No purchase, subscription, download or use transfers intellectual-property ownership to the user.
14. Prices, Orders and Payments
Applicable prices for physical books, eBook subscriptions, future audiobook subscriptions and other paid Services will be displayed before the transaction.
Payments may be processed through authorized third-party payment providers or applicable platform payment systems.
Amrita Books may, subject to applicable law, refuse or cancel transactions involving suspected fraud, unauthorized transactions, genuine pricing/technical errors, product unavailability or material violations of these Terms.
Unless otherwise expressly stated, applicable taxes, including GST, shall be charged as required by applicable law.
Where payment is unsuccessful, incomplete, reversed or subsequently charged back, Amrita Books may suspend or cancel the relevant order or subscription, subject to applicable law.
Placement of an order constitutes an offer by the User to purchase the relevant product or Service. An order shall be deemed accepted only when confirmed by Amrita Books or when the relevant product or Service is made available to the User, as applicable.
Where the Application is downloaded through a third-party app store, the User’s use may also be subject to the applicable app-store terms.
15. Subscription Period, Renewal and Expiry
The price and duration of each eBook or future audiobook subscription will be displayed before subscription.
Where automatic renewal is offered, renewal conditions, recurring charges and cancellation procedures will be disclosed before activation.
When an eBook subscription expires, the subscriber loses access to the subscribed eBook. Any downloaded/offline copy will be locked. The subscriber must renew/resubscribe to regain access.
16. Personal Use and Account Sharing
Digital Content subscriptions are for the personal and non-commercial use of the subscriber.
Users must not share account credentials, subscription entitlements or downloaded Digital Content to provide unauthorized access to another person.
17. Prohibited Uses
Users must not use the Services for unlawful or fraudulent purposes; infringe intellectualproperty rights; distribute malicious code; interfere with Application security; obtain unauthorized access; scrape or systematically extract protected content; circumvent DRM, authentication or device restrictions; or otherwise violate applicable law or these Terms.
18. User Comments and Feedback
Users may provide comments, feedback and suggestions regarding the Services.
Users must not submit unlawful, defamatory, abusive, infringing, malicious or misleading material.
Amrita Books may use voluntarily provided feedback for legitimate purposes relating to the development and improvement of its Services, subject to applicable law.
19. Service Availability
Amrita Books will make reasonable efforts to maintain the availability and accuracy of the Services but does not guarantee uninterrupted or error-free operation.
Maintenance, network conditions, third-party systems or technical circumstances may temporarily affect availability.
20. Right to Modify, Suspend or Withdraw the Application
AEPL/Amrita Books reserves the right to modify, suspend, discontinue or withdraw the Amrita Books Application or any part of the Services at any time and, to the extent permitted by applicable law, without prior notice.
Any such suspension, discontinuation or withdrawal shall be subject to applicable law and the rights of customers in relation to existing paid orders or active subscriptions.
If the Amrita Books Application or any paid Digital Content service is permanently discontinued and a customer has an active paid subscription, Amrita Books will refund the applicable subscription amount for the unutilized portion of the subscription period.
21. Suspension and Termination of User Access
Amrita Books may suspend or terminate a user’s access where the user materially violates these Terms, infringes intellectual-property rights, engages in fraudulent or unlawful activity, attempts unauthorized distribution of Digital Content, or compromises the security or integrity of the Services, subject to applicable law.
22. Disclaimer of Warranties
The Services are provided subject to applicable law.
Amrita Books does not guarantee that the Application or Services will always operate uninterrupted or without errors.
Nothing in these Terms excludes or restricts statutory rights that cannot lawfully be excluded or restricted.
23. Limitation of Liability
To the maximum extent permitted by applicable law, AEPL, Amrita Books and their respective directors, officers, employees, agents and authorized service providers shall not be liable for indirect, incidental, special or consequential losses arising from use of the Services except where such liability cannot legally be excluded or limited.
To the maximum extent permitted by applicable law, the aggregate liability of AEPL arising out of or relating to a particular transaction shall not exceed the amount actually paid by the User to AEPL for the relevant product or Service giving rise to the claim.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
24. Indemnification
To the extent permitted by applicable law, users agree to indemnify and hold harmless AEPL and its relevant affiliates, officers, employees and authorized service providers against claims, losses, liabilities or reasonable costs arising from the user’s material breach of these Terms, unlawful use of the Services or infringement of third-party rights.
25. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, the remaining provisions shall continue in effect to the extent permitted by applicable law.
26. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the applicable laws of India.
Subject to applicable consumer-protection laws and other mandatory legal requirements, disputes arising from these Terms or the Services shall be subject to the jurisdiction of the competent courts at Ernakulam, Kerala, India.
27. Changes to these Terms
Amrita Books may revise these Terms from time to time to reflect changes in its Services, technology, business practices or applicable legal requirements.
Updated Terms will be made available through the Application or associated website, and material changes will be communicated where required by applicable law.
28. Entire Agreement
These Terms, together with the Privacy Policy and any other policy expressly applicable to a particular product, transaction or subscription, constitute the terms governing use of the Services, subject to applicable law.
